Robert W. Lannan has represented clients in a variety of dispute resolution proceedings throughout the United States, including in litigation (trial court and appellate), arbitration, and mediation.

  • Has represented hotel owners in commercial litigation against hotel management companies arising under hotel management agreements
  • Has represented business owners in “business divorce” arbitrations against outgoing partners
  • Has represented property owners and contractors in litigation over alleged construction defects and other issues arising under construction contracts
  • Has represented debtors and creditors in adversary proceedings in Chapter 11 and Chapter 7 bankruptcy cases, including fraudulent conveyance and preference actions
  • Represented a hotel developer in litigation against its lender and mediation, which resulted in a favorable restructuring of a loan that saved the business
  • Represented a hotel owner in litigation and mediation that favorably resolved a dispute with a brand company over liquidated damages incident to termination of a franchise agreement
  • Successfully represented a property owner in litigation to enforce an easement
  • Represented a property owner in litigation alleging acquisition of title to real estate by adverse possession, obtaining dismissal of the action
  • Defended majority investors in a “freeze-out” action brought by minority investors alleging breach of fiduciary duties
  • Represented a hotel owner in an action to collect liquidated damages from a company that cancelled a large group event, achieving a favorable settlement
  • Represented a hotel management company acting as a receiver in litigation against an investor that purchased the debt and foreclosed on the hotel
  • On behalf of the owner of a historic commercial property in Chicago, negotiated a settlement with the City of Chicago resolving a dispute involving competing provisions of the city’s codes governing historic preservation and access for people with disabilities
  • Represented a hotel owner in an action to evict a long-term guest who had stopped paying fees and refused to check out, obtaining a non-redeemable judgment of possession
  • On behalf of a hotel owner, successfully conducted a UCC foreclosure on equipment previously owned by a commercial tenant that defaulted on its lease
  • Represented a decedent’s estate in litigation before the D.C. Court of Appeals, obtaining two successful rulings, including a favorable opinion
  • Defended the widow of a decedent in an action by the decedent’s children from a previous marriage contending that the widow had abandoned the decedent and was not entitled to distributions from his estate, negotiating a favorable settlement
  • Represented a decedent’s heir under his will in litigation against beneficiaries to the decedent’s living trust over whether the decedent had effectively revoked the trust before he died, obtaining judgments against two beneficiaries and negotiating favorable settlements with two others
  • Represented an agent under powers of attorney in litigation against a principal who alleged that the agent had breached fiduciary duties, obtaining a judgment in favor of the agent in court and dismissal of a related administrative action
  • On behalf of single parents of immigrant minors, have obtained, from state courts, sole custody and findings in support of Special Immigrant Juvenile Status (SIJS)
  • On behalf of a minor child, obtained SIJS and later Permanent Residence (a Green Card) from U.S. Citizenship and Immigration Services for one of the children.
  • Represented potentially responsible parties in Superfund litigation, toxic tort litigation and leaking underground storage tank cases
  • Represented a federal agency in a dispute with the Internal Revenue Service over collection of a federal excise tax
